Change to firm order process requirement for Revised terms and order process: IBM Machine Code License Acceptance Agreement

Today we are announcing the withdrawal of the requirement that starting April 1, 2014, customers sign either the ” IBM® Agreement for Acceptance of the IBM License Agreement for Machine Code” or the ” IBM Customer Agreement, Attachment for Acceptance of the IBM License Agreement for Machine Code” (either referred to as the “License Acceptance Agreement”) before IBM ships certain Machines, as originally announced for Revised terms and order process for IBM Machine Code License Acceptance Agreement, contained in Hardware Announcements ZG13-0034, dated February 19, 2013 and ZG13-0233, dated July 16, 2013.

IBM will no longer require that Customers sign and return to IBM an agreement documenting their acceptance of the IBM License Agreement for Machine Code as part of the order process for the following IBM Machines:

IBM System z® : 2097, 2098, 2458, 2817, 2818, 2827, and 2828
IBM Power Systems™ : 9109, 9117, 9119, and 9179
IBM Storage Systems: 2421, 2422, 2423, 2424, 3592, 3952, 3956, and 3957

Machine Code on such Machines remains subject to the terms of the IBM License Agreement for Machine Code. For such IBM Machines, the user will convey its acceptance of the IBM License Agreement for Machine Code through the use of the Machine. Such IBM Machines are now designated as “Acceptance-By-Use Machines” as described in the license.

IBM Machine Code is copyrighted and licensed (not sold). IBM licenses Machine Code to the Licensee under the terms of the IBM License Agreement for Machine Code.

IBM will continue to work with its customers to obtain written acceptance of the IBM License Agreement for Machine Code.
